A Macon man faces three counts of first-degree sexual misconduct after authorities say he exposed himself on the beach at Long Branch State Park.
Kevin Faye Britton, of Macon, was charged July 9 in Macon County Circuit Court with three counts of sexual misconduct in the first degree, a class B misdemeanor, according to court records. The charges stem from conduct alleged to have occurred July 8.
In a probable cause statement, a Macon County sheriff’s sergeant wrote that Britton was on the beach with his genitals exposed where three women were able to see him. One witness reported that Britton exposed himself from the side of his shorts and masturbated while watching other beachgoers, according to the statement. All three reported that he exposed himself several times and was recording other women and children on the beach.
In requesting a warrant, the sheriff’s office cited the nature of the allegations and the beach setting, and stated a belief that similar conduct could recur where children would likely be present.
Judge Kristen Burks found probable cause and issued an arrest warrant July 9, setting bond at $10,000, cash only. The court found reasonable grounds to believe Britton would not appear on a summons or posed a danger to the victim, the community or others. Court records indicate the warrant was served the same day.
First-degree sexual misconduct under Missouri law, Section 566.093, RSMo, covers exposing one’s genitals under circumstances in which a person knows the conduct is likely to cause affront or alarm. As a class B misdemeanor, each count carries a penalty of up to six months in the county jail, a fine of up to $1,000, or both.
The charges are allegations. Britton is presumed innocent unless and until proven guilty in a court of law. The case, No. 26MA-CR00202, is pending in Macon County Circuit Court.
